The purpose of this manual is to inform requesters of the records held by Lunatree, to describe the categories of those records, and to explain how a request for access may be made under PAIA.

5. The SAHRC Guide on How to Use PAIA
The South African Human Rights Commission has compiled a guide, in terms of section 10 of PAIA, to assist members of the public in exercising their right of access to information. The guide is available in each of the official languages and may be obtained from the Information Regulator. Enquiries may be directed to the Information Regulator at the contact details set out above.
6. Records Held by Lunatree
Lunatree holds records in the following categories. Records marked as available without a formal request may be obtained by contacting the Information Officer.
- Company / statutory records — incorporation documents, registration certificates, and statutory registers.
- Financial / tax records — accounting records, invoices, bank statements, and tax submissions.
- Customer records — account details, order and delivery history, and correspondence.
- Employee records — employment contracts, payroll, and personnel files.
- Supplier records — supplier agreements, purchase orders, and correspondence.
- Marketing records — customer mailing lists, campaign data, and analytics records (including Google Maps API and Facebook custom audience targeting data).
Certain records — such as the published terms and conditions, privacy policy, and product information available on the Website — are available without a formal request.
7. Records Held Under Other Legislation
In addition to the above, Lunatree holds records in accordance with, and as required by, other legislation, including:
- Companies Act, 2008 — statutory and company records.
- Tax Administration Act, 2011 — tax and financial records.
- Basic Conditions of Employment Act, 1997 (BCEA) — employee and payroll records.
- Protection of Personal Information Act, 2013 (POPIA) — records of the processing of personal information.
8. How to Request Access
A request for access to a record must be made on the prescribed request form (Form 2 of the regulations under PAIA). The completed form must be submitted to the Information Officer at the address, email, or fax set out in this manual.
- Processing timeframe: Lunatree will respond within 30 days of receiving the request, subject to the extensions permitted by PAIA.
- Prescribed fees: A request fee and an access fee may be payable as prescribed in the regulations under PAIA. The Information Officer will notify the requester of any fees due before processing the request.
9. Grounds for Refusal
A request for access may be refused on the grounds set out in Chapter 4 of Part 3 of PAIA, including, but not limited to:
- the mandatory protection of the privacy of a third party who is a natural person;
- the mandatory protection of the commercial information of a third party;
- the mandatory protection of confidential information of a third party;
- the protection of the safety of individuals and the protection of property;
- records privileged from production in legal proceedings;
- the protection of Lunatree's commercial information; and
- requests that are manifestly frivolous or vexatious.
10. Remedies if a Request is Refused
If a request for access is refused, the requester may pursue the following remedies:
- Internal: request that Lunatree reconsider its decision by contacting the Information Officer.
- Information Regulator: lodge a complaint with the Information Regulator (South Africa) at the contact details set out in this manual.
- Courts: apply to a court of competent jurisdiction for appropriate relief.
